Of course, I do not know the contract. But according to the [Baugesetzbuch], a smaller quantity certainly means a lower price. The described situation cannot lead to an additional price! Not for the ridge and especially not for the smaller quantity. That would be a business model.

The specified roof area was 120m² and according to his survey, it is 89.96m². That means 74.967% of the original area. Even with the 9% price increase, the roof was overall cheaper. I could take the measurements again, but roughly it should be correct.

So please once again! You have a price per m² of roof surface. You now realize it is less. Why should that be a 9% price increase and why 9 and not 6.4? No! It is not! With what justification is less roof more expensive? You are really getting ripped off right now!

He says that the price per sqm was increased by 9% because the area was almost 40 percent smaller than advertised.

You have general costs as a construction company per site. Be it travel, construction management/ coordination, measurements, invoicing, etc... Let’s say as an example €1,000 in costs. He calculates that per m². For example, at 100 m² €10/m². If he is now only to build 60 m² (because of your fault), his costs are not covered and he is missing €400. He has a claim to this (under valid VOB). For a 40% shortfall, 9% cost is not unfair.

I also find that understandable. 40% shortfall is quite significant.
