Hello,

I have a question regarding the last payment to the architect. We are currently in the last third of the construction. According to our architect, we should pay the final invoice after the tile installation... But the tiling is not finished yet. Then the sanitary installation comes, the final electrical assembly, the painting work...

I would rather understand that the last payment is made upon the complete completion of the construction measure? Before I discuss this with him, I wanted to first get your opinions here, so that I am not on the wrong track!

hm, strange. Are you sure this is supposed to be the final invoice? Or a partial payment?
So the architect, assuming he is commissioned for the entire service phase 8, has not yet completed his work. So no final payment.

It is definitely the final invoice, he told me so himself and meant that he is still around anyway, which I do believe and know...

But I don’t quite agree and will definitely withhold something...

Don't you have a contractual payment schedule specifying when what is to be paid?
A final invoice is understood to mean that payment is made when everything is finished ...
Personally, I would not pay the final installment before the work is completed, based on statements like "he is not out of the picture" ... no, that would be too risky for me ...

In our contract, the final installment is the last three % after handover of the house ... (so finished)

No, there is nothing regarding this in the contract with us! I will definitely handle it in such a way that I leave something leftover until everything is finished! Better safe than sorry... ;)

... but it is not very sensible to have no payment schedule. It must be agreed somewhere when what is paid. For additional work that we hand over to our contractor, it is handled so that we pay 60% in advance and the remaining 40% upon completion. On the other hand, for each partial payment (after the shell construction, after the roof, etc.), 3% of the invoice is always withheld as security. So that after completion of the house, we basically still hold 6% of the agreed house price. 3% final installment + 3% security retention ...
