The architect just has to make an effort. As a reward, the cleverest house on the street awaits – hardly a reason to feel down.

The tree is protected - how close you are allowed to build to it can be found in the relevant building regulations - these should be studied anyway before you start the project. It is to be assumed that building around the tree will be more expensive than without a tree, this should be reflected in the property price.

Why is a pine tree protected? I could still understand that with a wild service tree. Pines make a lot of mess, I have one myself but far away from the house, yet I still have to sweep the driveway every week. Pines have deep roots, so unlike spruces, they are not shallow at the surface and withstand almost any storm. What if the tree suddenly gets sick and dies???? (a knave who...)

With the incubation period such a tree has, you can then build many years later after a sudden illness of the tree. The Lord punishes small sins immediately

Hello,
thanks first of all for the answers. I had now called the environmental office of the district about the topic, he only told me that the municipality is responsible here and I should ask about the tree statute.
I then submitted an inquiry to the municipality....answer is still pending. Why they specifically marked the part in the development plan as protected I also cannot understand. The building land itself is 30x15 m and they had to protect the tree in the building area of 19x12 m. I hope I am allowed to fell it (compensation or offset payment would be totally okay) it just really disturbs... And you are supposed to protect the tree from work in the crown circumference (approx. 5-6 m diameter of the crown).... means for me an even smaller building area... I did not just want to build a garden house with 40sqm. I attached a picture

Some tree has to be preserved, and this one, I'll just say it directly, really hardly disturbs anything unless you want to build a large bungalow. Based on the previous statements, I would have expected worse.
