Does one have to file a lawsuit immediately? Or is it also possible to file an objection against the rejected notice, to which another instance then issues a notice of objection. If so, the instance may have a different opinion.

From my point of view, they have also understood this completely correctly – with the restriction concerning field 2 that I already mentioned. Beyond that, however, I see no further restriction solely based on

because in my opinion it is not defined clearly enough here if the municipality wants to limit the "outside" to "but within the specified building depth." Then they should kindly draw explicit Ca/Cp special windows for plots 1 and 4 in their "outer" construction zones in the plan. Due to the lack of clarity, I see good chances of overturning a rejection just because of that. But the expert for this is .

Oh, I just see: they did!

I initially referred the special areas mentioned here to separate garage yards - but in the plan it can be seen that areas are meant which are drawn on some plots as additional building fields - but not on all. So it is probably clear even without an expert: if your plot is not blessed with such a special building field, then only your "F1" is allowed.

Just generally ... what's the nonsense with a survey. Just because maybe the majority votes for one option, it doesn't mean it's RIGHT. Sometimes you just have to shake your head.

Since we are not construction professionals, we wanted to form an opinion on whether only we have misunderstood the [B- Plan] so far. The building authorities have the power, even if [B -Pläne] are textually flawed. That is clear to us. And legally, as a citizen, you can’t expect any chances anyway.

In the specific case, you have merely read the plan carelessly. A development plan is always one plan, i.e., you only partly become clear from both image and text, and "individually" it still lacks clarity.
