Read what this is about. The driveway does not lead onto the street but runs parallel to the street and complies with the state building code.

Here the only question is how big the thing will be. Whether a building application is required depends on that. Up to 2.5 m width without a building application.

Yeah well, if you can build up to public spaces outside the building boundary in Lower Saxony without a permit, then I guess that's how it is.

I just never understand what stops someone from writing an email to the building authority and asking. Then you're safe, you have it in writing. Is that so hard...

No, there is a development plan here that prohibits this within the first 5 meters. That is what the question is about. It is also about the neighborhood, which is different. However, what I find missing in all threads is a drawing. Because it could still be about the corner of the corner plot - and that is often considered specially.
