Good evening everyone, we are currently building a semi-detached house. We have agreed with the direct neighbor that we will install a 1.8m high fence, including privacy screens, between our terraces. Unfortunately, we do not know the neighbors of the other property (long side), but we have already commissioned the fence. It is intended to separate our properties. Now we are afraid that we might have problems with our neighbor, the general contractor is obstructive and does not provide any contact information. We are considering installing the fence 50cm away from the property boundary and, if there is a problem, planting a hedge behind it. We hope this is understandable.

The development plan from 1995 stipulates that only a hedge is allowed for fencing in the area. Nevertheless, many have a fence, so to be honest, we did not really consider this.

We thank you in advance for the answers.

Don't you know the neighbor because [the neighbor] is still unclear? If not, get to know him. If yes; don't worry and put the fence on the boundary. There is a certain probability that he likes it and is happy not to pay anything.

Why? You are allowed to put up a fence as long as it fits within the development plan. Sometimes you even have to (e.g., with animals) Basically, if applicable, the neighbor law of the state applies if the development plan says nothing about it.

In the development plan it says:

For the delimitation of properties of single-family, semi-detached, and terraced houses, hedges according to Part E - Plant list are to be used instead of fences. Hedges must not be taller than 80 cm.

In the building area, there are many fences. That’s why we are uncertain. We only read this after the purchase.

Then just put the hedge on the boundary.

Yes, and a fence would be possible behind it, right?
