Distance from neighboring property/height?? What is allowed? Confused

Hello, I am new here and absolutely inexperienced in construction. After much consideration, I have now decided to build. After viewing the plot, a question has arisen. I hope you can help me. The development plan states a mean wall height of 6.5m and 5.5m and that the distance areas according to BayBo must be observed. See also attachment. However, the neighboring plot is built with a city villa with a height of at least 8m and 3m from the property boundary. Are there any special regulations? Can anyone give me information about this? Regarding the permissibility or should I buy another plot? I definitely want to avoid trouble after the purchase because of something like this. Thanks in advance for the help.

Basically, in Bavaria, the distance area must be as many meters as the house is high, whereby the gable area only counts as one third (as long as the roof has a pitch under 70 degrees) - at least 3m. This is rather counterproductive, especially for densification, but that's another topic. It will also change over the course of this year. However, there is already a regulation that states that the height on two sides of the house, which are not longer than 16m, may be halved.

So if the townhouse is 8m high, then presumably the 16m privilege has been applied here or a building encumbrance has been registered on the adjacent property. Or else it is indeed 4m away from the boundary; one also tends to misjudge such dimensions sometimes.

Thank you for the answer. No, it is 3m, we checked online in the Bayernatlas and I obtained a measurement of our property where you can see the 3m from the neighbor. According to the building authority, there is also no registered encumbrance. But even with this 16m rule, the distance must not be 3m, right? The neighbor's house has a length of 11m and is connected by a 4m windbreak to a 6.50m garage, all masonry. Which would then be more than 16m, or does only continuously equally high masonry count?

Phew, don’t hold me to it, but I would now say that a garage doesn’t count in there. Theoretically, you could even build it directly on the boundary. Aside from that: The house is 8m high ---> 16m privilege, so 3m distance is okay. The vestibule is probably not 8m high, right? Let’s assume it is 3m high --> doesn’t even need the 16m privilege, because it already fits.

Then theoretically I could also build a full-story house with a hipped roof with this 16m rule? Or will there be trouble with the other neighbor if I put such a large block in the sun there?

Because of the sun, there can be no trouble there. You just have to be careful because the 16m privilege only applies to two sides of the house.
