Dismantling of a construction road

Hello everyone,

is the dismantling of a construction road normally part of a shell construction contract or excavation?

Background: I hired a construction company to carry out the shell construction for my extension with a basement. For the excavation, the construction company in turn commissioned another company, which I paid directly later on (so not through the construction company). A construction road was necessary for the shell construction/excavation. Now I am being told that the dismantling of this construction road was not part of the offer, but if at all, would have to be commissioned and paid for separately.

My question: How is this normally handled? To me, it would be like if the plasterer left his tapes and foils in the house after finishing his work and left the removal of them to the client because it was not explicitly stated in the contract.

Normal is what has been agreed upon.

And if only the manufacturing was commissioned and not the dismantling, then that is how it is.

You can also agree with your Gisper that he can leave everything as it is and therefore the price is lower.

That is already clear to me. However, as a rule, the offer from the plasterer does not list "removal of tape and foils" as a separate item. In other words: it is "normal" that he takes down/removes the materials he needs for proper job execution. Similarly, I wanted to know if this is "normally" handled the same way regarding the construction road.

Well, tape is something different than 20 tons of construction road. And the tape is ancillary, the construction road is the main thing.

So the question remains: Was the construction and dismantling ordered or only the construction.

The plasterer also doesn’t go and knock out the plaster as the last step.

That's a matter of opinion: In my view, the shell construction and the excavation are the main things, not the construction road. It's needed to be able to work comfortably - like the plasterer who doesn't have to be careful when masking. But whatever, that's not what it's about anyway ... at least it seems like it's not "normal" when I read the comments here ...

Layperson's opinion: The construction road is part of the construction site setup, like the toilet, the construction fence, the construction power supply, etc. It is by no means comparable or to be confused with the masking by a painter or the formwork by a structural carpenter. Thus, the topic of the construction road falls within the responsibility of the client.

Otherwise, it depends on what was agreed upon. Who commissioned the construction of the construction road?
