Development plan interpretation of building regulations

Hello everyone,

I am currently struggling a bit with our building regulations and have two questions.

1. The knee wall must not be higher than 50 cm. Now I have found a house in the residential area that apparently has it higher (ratio of window bottom edge to the intersection of the roof at the outer wall). Who can or must tell me what the municipality has already approved in the past? And if it has already been approved once, can I then automatically assume that this is the new standard?

2. The aspect ratios must be 1:1.2 in a rectangular building. How do bay windows that are built in the middle count, or how is their length and width defined? I would actually need more of an "L" than a square.

If you want to build against the applicable development plan, the building permit must be approved by the district office. The procedure is then significantly more complex.

As long as the development plan is complied with, the municipality/city can decide on the application itself. At least this is the procedure in Bavaria.

However, your construction project can also be successful, provided the approval must be obtained through the district office.

Hello Pacey82,

You have a contract with your architect (or should have one) which states that your architect is responsible for the approval planning - for which your architect receives a considerable fee.

This includes answering specific questions about your construction project as well as possibly about other permits in your construction area. In order to answer your questions here in the forum, _all_ information needed for this would have to be available, which is usually almost impossible to achieve.

For that, you have to call the responsible building planning office; i.e., the office responsible for building permits (it may have a different name in Bavaria). Whether bay windows or conservatories are permitted is determined by the textual provisions in the development plan. Since you have not posted the relevant description here, no one can answer the question. I would advise you to clarify these and other questions in a personal conversation; surely there are also public consultation hours in the offices in Bavaria. You just must not assume that every supposed deviation from the development plan in past years automatically means a green light for your building project. So treat the caseworkers as you would like to be treated yourself; then an informative conversation should result for you. Rhenish greetings

An L can be created by a bay window. A bay window would be subordinate to the house side. However, a centrally positioned bay window does not create an L. How large a bay window can be in your region of Bavaria: state building code or development plan. Since when can the height of a knee wall be recognized at window sills? For example, we have three different ones above, and now you come ;) Greetings
