Nonsense, the building authority has not given any answer on this so far, only the municipality. But it has no decision-making power. And yes, one can also sue if one believes to be in the right.

No building enquiry is necessary here yet. Write to the building authority asking whether the property a) is within the scope of a development plan, b) is in the unplanned inner area (§34 Baugesetzbuch), or c) is in the outer area (§35 Baugesetzbuch). They must truthfully answer you even without a formal building enquiry. In case C, you are a farmer, forester, or hopeless.

Strange, I am neither a forester nor a farmer and have built in the outer area. And after us, another five have too, although it is still not building land. I’m not saying the chances are very high, but it’s not always "hopeless".
