Construction financing only through one spouse

Hello,

I have been married to my wife for two years. Out of shame, I did not tell her that I am still in the good conduct period of my insolvency. Now she actually wants to build a home. She earns very well. My question is whether she can also take out a loan alone and, for example, "sublet" part of the house to me so that she would have even more income to support the financing. Only then could I support her with my earnings. I would like to help her realize her dream.

Rent must be declared as capital income in the tax return. Your extra income to your wife would therefore be unnecessarily taxed twice. Whether anyone would believe what you are doing; I also doubt rent from a spouse.

I cannot imagine that this can work.

Haven't you told her yet? I would be surprised if my wife suddenly came up with such an idea and didn't ask a few questions.

I believe it's time to put all the cards on the table. Not being honest with each other in such a matter is a very poor basis for building a house. And if your wife happens to find out about it from the bank, it would be very embarrassing. Just for your information, under [Insolvenzbekanntmachungen] anyone who knows your name can check this. Many banks do this when only one spouse insists on taking out the loan.

Rent between spouses is not recognized, unless it is a self-contained apartment that is used separately or a self-contained office, for example, rented by a company where the spouse is the owner.

Hello,

I would seek a clarifying conversation with her. For me, it would be a breach of trust if my partner only told me something like that after 2 years of marriage. It is also not a solid basis for a Bau.

If your wife earns well enough to cover the finances, the bank probably doesn't care whether you are able to pay or not. But lay your cards on the table, it will come out anyway eventually.
