Construction contract: Which tiling works are included in the fixed price?

Hello everyone,

in our construction contract there are – in my opinion – contradictory statements regarding the included tile installations. Therefore, I would like to make use of the collective intelligence of the forum.

The two relevant contract passages are as follows:

    [*]Bathroom: walls will be tiled 1m high all around, showers up to 2.2m high
    [*]For wall tiles […] we have planned 20m² per bathroom

Now, during the sample selection, it turned out that we have a demand for wall tiles for the bathroom of about 30m² if we tile all walls (as suggested by the general contractor and described under passage 1) 1m high and the shower 2.2m high.

The general contractor would now like to charge us for 10m². Now I am wondering whether we actually have to pay for the 10m² or not.

Perhaps someone of you has already had a similar situation.

I understand the height specifications as a description of the technical structure, the sqm specification as the basis for the scope of services.

How many bathrooms are planned? And will all of them exceed these 20 m²?

Did the gu write these 20m2 into the scope of services? If yes, then of course you have to pay for everything that exceeds that. He can’t help it if your floor plan enlarges the bathroom.

The construction performance description is general. It contains the square meter specifications that I listed under No. 2. After completing the planning, we received an additional agreement that specifies certain points. The passage listed under No. 1 comes from there.

: We have further bathrooms where the square meter specifications are also exceeded.

Have the bathrooms been changed in the floor plan? Specifically, enlarged so that the required area is greater than in the original. If not, ask the GÜ how he would install 20 m2 of tiles with the given 1m perimeter and a 2.2m shower in the unchanged floor plan.
