City villa with 2 residential units, problems with the development plan

Hello,

I have a problem and hope someone can help me here.

Situation:
My mother is 100% disabled (she has MS) and is retired. My parents live in a very large house. Now my father suddenly passed away and everything is becoming too much for my mother with the large house and even larger property.

Idea:
We had considered buying a plot of land together in the new development area of our community and building a townhouse on it. This townhouse should have about 2 x 120 sqm of living space with 2 separate residential units. > all built to be disability-friendly (because of my mother).
The plan was that my mother would move into the lower unit and my family into the upper one. This way we would be a family under one roof and in case of emergency we could help my mother (possibly care etc. etc.)...... We could then share the costs and each would have their own living space, but in case of need, be close by.

Development plan:
The development plan now states the following: >

However, the mayor hinted that the community would certainly be flexible here if a corresponding application were submitted.
The building committee also approved the application to amend the development plan. Unfortunately, the municipal council narrowly rejected the application (for whatever reason). Maybe it is also because there are currently elections here and political games are being played against each other.
Many plots have been vacant in the development area for a long time. And the already built houses are also very large > over 200 sqm.....

Question:
How can the project still be realized? I spoke to a construction company. They told me that one could formally apply for a single-family house. With one entrance. Inside the house, a small hallway would lead to the two separate apartments.
We would then also move into the house as a "family".....

Do you have experience here, other ideas, tips and tricks on how to proceed?
I am really very grateful for help.....

The following is stated in the development plan:

"per single-family house, a maximum of 1 apartment is permitted. (§9 (1) no. 6 Building Code)"

In my opinion, this will be the most elegant solution. It would only remove the family's nitpicking, because you are one ;) I think that according to the development plan, an apartment is usually only approved because of the parking spaces. This restricts the number of cars, since often only one parking space per dwelling unit is allowed. You could separate 2/3 of the ground floor for your mother, use the remaining part as a technical room and common family room with access to the garden. With a clever architect, this can certainly be implemented well. Later on, however, you must not rent it out further, but there is always a way to divide the rooms for whoever as needed :)

that was the idea behind it.....
By the way, the development plan provides for 2 parking spaces per residential unit. If we had been officially allowed to build a two-family house, then we would also have planned 4 parking spaces (double carport + 2 separate parking spaces behind it). But now we have to see. :D

Therefore, it's all the more incomprehensible why our application was rejected.....

I am grateful for any further ideas or suggestions :o

Well, what happens behind the facade does not matter. But it has a different visual character when an entire fleet (and I also see 4 cars) is parked permanently in front of the house. Thus, two-family houses are simply prohibited! (there are probably other reasons, but I do not know them at the moment) Maybe also because the district/municipality plans heads per house/sqm accordingly for the entire infrastructure.



I already said: it is the most elegant.
If you prefer to complain...... be my guest ;)

Sorry, of course there is another solution: You renovate the mother's house and move there :)
