Schwimbi, why don’t you talk to the city on Monday? And express your frustration there, politely but clearly say what you want and why they now want to ruin the land register for you. And then listen to what they say. Only the one who speaks can be helped, we always say here at the office. Karsten

Then there were probably more (holiday apartment) speculators in the first phase than the municipality was willing to tolerate. Land development ultimately has structural political goals; the promotion of profits in real estate trading is not among the motives of the public sector. And an unenforced sanction would be equivalent to a powerless one.

Isn't this usually resolved by a reservation of a claim for retransfer? The amount of the penalty is a joke in this context; it is usually significantly higher.

We also have a reservation for retransfer, but it serves to secure the construction obligation within 3 years. The penalty for non-self-use is similarly high (€16,025 or €25/sqm), and you have to see that relative to the land price (€/sqm 105 in our case, so 25 is an effective deterrent. In Munich, however, it wouldn't matter anymore...)
