Hello,

I am currently facing a possible problem, which is probably my own fault. We want to build a house, and for this, we have concluded a contract for work. This includes the architectural service for the house. At the first appointment with the architect, the question arose whether he should include the garage in the plans; that would be done then. I should have asked about the additional cost right away. We were confident, and we liked him.

We roughly described what we imagined, but he kept assuring us that the design would be up to us later and that we would have 5 years for the construction. So that was fine for us.

After a lot of back and forth, we have now received the building application documents. Unfortunately, we feel that this was handled somewhat uncooperatively and partly incorrectly. We are supposed to delete the wrong information and correct it ourselves. That’s the background.

My actual problem now is that he drew the garage on the site plan at his own discretion and planned the drainage for it; there are no further documents. From our point of view, that is fine. We have now seen for the first time in the building application that he estimated construction costs of 46,000 €. In principle, acceptable, but now I fear that the good man will send us a princely bill even though this was never agreed upon or the planned cost framework defined beforehand.

I think as soon as we sign this, the matter is over for us. I fear that we will then have to pay something around 5,000 € just for this. Do you have any experience with that? He didn’t really plan anything for us, he just reserved the space on the property for it?

For the fact that the architect commissioned by the construction company draws a garage procured "by the client" as a dashed-line dummy in the site plan and similarly takes it into account in the drainage planning, you certainly will not have to pay his services as if this garage were part of the scope of work he planned. However, it does not make sense from my point of view that he estimates its approximate costs. If the garage price seems too high to you, this impression will quickly be put into perspective if you ask garage sellers for their offers. Garage prices are probably the origin of the term "concrete gold" *LOL* The assumed garage price may perhaps play a role for the fee of the building permit procedure.

Garages are procedure-free under certain circumstances in some federal states. However, also consider the delivery of prefabricated garages, for which it might be cheaper that the roof overhang of the house does not yet exist.

That is common and safe if the draftsman includes a later planned garage or carport in the building application. The cost of the building permit is determined by the costs. However, 50,000€ is not a big deal. And it has one good thing: now you have a house number for the massive double garage in EL and can already increase the loan ;) However, you do not have to build it, of course.

That reassures me somewhat. I also found out today that the garage does not comply with the development plan and he did not include it as an exemption either. That now fits perfectly with the whole story with this guy.
