Building in the backyard / garden?

Hello dear forum,

after looking at some building plots, we are a bit disillusioned. The nice ones we can afford are simply too far away. Now we have maybe considered whether we could build in the garden. Our neighbor has an old workshop in his garden that he rents out as living space. I haven’t been able to look at the development plan yet, since the house belongs to my mother-in-law and we just want to inform ourselves in advance whether something like this is even possible. Presumably there is no development plan, since everyone has built differently here. The plot is 16 meters wide. The garden is approximately 21 meters long. Of course, it is far from large. However, the land prices here are so outrageous that an average person cannot afford it.

What do you think? Is something like this doable? We would tear down the garage of the front house and pave it as a driveway. That’s the idea. Of course, only if that’s okay with my mother-in-law.

Cool, the person concerned and owner doesn’t know about it yet? Hehe...

I don’t think much of things like “building in the garden,” since they are usually crazy ideas, but it seems that in this area everything may be paved or built on?!
In this respect, the development plan is the most important basis. You can’t tell much just by gut feeling, but the map shows that mother’s garden is the only existing oasis in this area.

Well, the problem is less about the existence of the property. The price per square meter is simply too high for what we can afford. And here are the circumstances why we even want to build in the garden:

We have been living together for two years in the front house with our grandma and take care of her a little. She lives on the ground floor, we live on the upper floor. However, our upper floor only has 55 sqm of living space. We still use the kitchen on the ground floor, but by now we have a small son and number 2 is on the way. So the space will not be sufficient for much longer. If we could move into the garden, we could continue to take care of grandma and at the same time have enough space. Unfortunately, nothing can be changed in the house itself so that we can live with it permanently.

In the picture, I cannot see any disorder. It may be that the existing development was created according to §34. Whether a development plan is drawn up for a "densification" is locally different and becomes less likely the fewer plots in this area still offer building site reserves. By the way, even without a development plan, there can be a local statute that regulates, for example, the extent of buildability (or defines alignment lines). Asking costs nothing: the building authority of the responsible municipality can say which legal framework applies. Your plan is certainly not unreasonable, and many municipalities are open to such things.

Inheriting, gifting (both definitely) and possibly selling within the family are detrimental to Baukindergeld funding.
