In the initial post, you quite openly show a willingness to breach the contract to avoid your own disadvantages. That simply creates a negative impression.

That is absolutely not true and does not correspond to the truth! Where did I say that? Breach of contract is NOT an option for us. We have lost 7 months since the contract was signed. Surely it would simply be crazy to even consider something like breach of contract now. Everyone here seems to read only what they want. Everything except what is actually written and meant.

I must be simply reading it wrong if the possibility of refusing an obligation is not considered therein. I have now understood that you do not want to breach the contract.

That’s right :) maybe I also expressed myself incorrectly. Because you are not the only one here who misinterprets my intention. Ideally, I am looking for a way to reach an agreement without getting into conflict and without involving a lawyer. But nevertheless, I want to be fully informed about the legal situation and my rights before the conversation.

The only security for you now can only be the demand for a performance bond.

Yes, but only if the general contractor continues to insist on a bond/assignment (?). I wouldn’t just barge in with the goal of a conflict-free solution.
