Hello everyone,

I would like to ask for some crowd wisdom because I am currently a bit "puzzled" or starting to sweat a bit.

I am part of an inheritance community of a total of 3 parties. It concerns a plot of land of 1000 sqm in BaWü. Guideline price for farmland is 10€/sqm & land value if building land is 700€/sqm.
Well, whatever, as it usually is, the land is not yet building land, but borders directly on a residential area. According to consultation with the city, it will not be building land for the time being and due to its small size is not of interest to do anything with it...

I or rather all of us in the community would still like to sell the plot and, after consulting with a broker, expect a value of about 300€-400€ per sqm. (We will not let it go for less)

Now the broker has drawn up a contract for us. Unfortunately, I am getting cold feet now; do you see any problems in the contract? Because of course, we only want to pay when a contract is signed and the interested parties pay more than 300,000€. If no offers or cheaper ones come in, then we do not want to sell.

What do you think about the broker? Can you just get out after one year and what happens if we reject the offers for any reason?

Do I understand correctly that you want to sell the farmland, which the city said will not become building land for the time being, through a broker to some (sorry) idiot who is supposed to pay €300/sqm for it, in the mistaken hope that he might be allowed to build on it someday? O.o

That was not my question! Yes, it is farmland but yes, it will quite certainly become building land at some point! Whether now or in 10 years, the buyer will have to be aware of that. (If anyone can be found)

The price is unrealistic for anyone who does not have good insider information from the municipality. Therefore, the brokerage contract is worthless for you. The agent will do nothing and just fill their pockets if it becomes land with development potential. You can keep the land without a brokerage contract. Sell it when the time comes.

I don’t quite understand. I thought he only gets paid when a purchase contract is concluded and receives the commission from that. ?

No, it doesn’t have to. There is always an end somewhere. A border. And on one side of the street, there is a development plan with many nice houses, next to it only apartment buildings, and on the other side there is forest or farmland, and that stays. No one will buy there without a guarantee. That’s why many plots are sold with a positive preliminary building inquiry. The sellers front money for this inquiry plus possibly an architect’s plan. Anyway: why use an agent? I would sell something like that myself. For the hoped 3 x €100,000 or more, one of you can take care of it. That person would then get a small bonus. I would never bind myself to an agent. Otherwise, you don’t need to get cold feet. Or do you have to pay something?
