Boundary construction garage, windows possible

Hello,

I have a question about a garage with 7m width and 8.5m depth, which is to be built on the property boundary. The house is on the right side, and the back wall is on a slope. The left side of the garage with 8.5m depth is directly on the property boundary. I would like to have daylight in the garage, but only the left garage side remains available for windows. The neighbor has already built and has about 3m distance with his house from my garage. Can I install windows there? What fire protection class must these windows have? Can the neighbor refuse the windows?

Please no unnecessary discussions about why I want windows, I just want some.

We solved the problem with windows in the ceiling (skylights).

My ideal solution would be glass inserts in the garage door.


I am afraid that since he will hardly move his house another three meters away from the boundary now, even with his consent the building authority will say "no."

Hello, thanks already for the answers. I have also thought about the skylights, but I would prefer windows. A civil engineer I know said that glass blocks could be installed in the wall. But if those were allowed, then theoretically there would be nothing against fire protection windows either. It is only about fire protection, right?

I browsed a bit through the BayBo. In Article 43 it states that windows at distances of less than 0.6m must have a minimum sill height of 1.8m upon the neighbor's request. Therefore, windows should basically be possible. If the neighbor agrees, lower windows would also be allowed; if not, then 1.8m sill height, which would not be a problem for the garage because I want light in the garage, not a view. What do you think about that?

As far as I know, windows in boundary constructions are generally prohibited. Exceptions must be mandatorily registered in the land register and require, in addition to a valid justification, also the consent of the neighbor (and I would probably rather not give it).

If a window is then approved, it must, to my knowledge, be an F30 window. Glass blocks meet F30, but you won't get an entire wall of glass blocks approved either. It's also about granting the neighbor a certain amount of privacy (hence the minimum 1.8m sill height).

Before you plan further, I would first ask the neighbor if he would be willing to agree. If he says no, you can forget about it anyway, even with a sill height of 1.8.

And you have to be aware that you will have additional costs for the land register entry (it won't cost the world now, but it must be done - otherwise the neighbor who agreed verbally might sell, and the next owner could demand the demolition. So secure it in the land register!)

By the way, you have daylight in a garage when the garage door is open—and in sufficient measure too.
Is the garage heated? Because you obviously want to use it with the door closed.
