BG Bau wants information about our financing

Hello,

the BG Bau wants to know something again.

Among other things:

"Who has borne the construction financing in what way?"
or
"Who has concluded loan agreements with which bank (attach copies of the credit agreements)"

I am now wondering whether I have to provide information about this at all.
The cover letter states:

"
Due to the obligation to provide information, we refer to §§ 191, 192 Social Code (SGB) VII in conjunction with the
statutes of BG BAU.
"

I checked there and only considered the following paragraph to be relevant:

"
(5) Building owners are obliged, upon request of the responsible accident insurance carrier, to provide the information necessary to fulfill the legal tasks of the accident insurance carrier (§ 199). This includes
1.
information about whether and which non-commercial construction work is carried out,
2.
information about which contractors are commissioned to carry out the commercial construction work.
"

From this I conclude that I am not obliged to provide any information about our financing.

Am I wrong? How was it for you?

I find that at least unusual. They also wanted to know quite a lot from us, but specifically only things like "Which trade was performed by which company," "Where own contributions were made," and "What was done within which time frame with construction helpers."

If in doubt, just call the provided phone number and ask what this is about and what difference it makes for the BG whether the house was paid for with own funds or with the help of a bank.

The only thing I could derive in a layman’s way is that it is unclear to them who is the owner and who is the builder and thus falls under the insurance obligation or possibly not. However, this could have been formulated differently.

I would be curious to hear the answer.

Would be interesting to me as well.

We had the same questions as - and this has already been asked several times. Since we award trade by trade ourselves, we can only provide information in bits and pieces.

One might think that those who use 100% debt capital would not (knowingly) have undeclared work in construction, since every euro must be documented to the capital provider. Accordingly, builders with equity and/or own services would be more suspicious. But this is just my attempt to find meaning in this strange question. If I were right, this mode of questioning would seem very suspicious to me.

We probably received the same letter. Only he is listed on the building permit and in the land register with us. Nevertheless, I also see myself as the builder, after all, we make every decision together and pay for everything together - even if only he applied for the loan (-> because of the land register; I'm not stupid and won't sign if I don't own anything afterward). So I put myself as the builder on the first form - I suspect that's why the second form came and the building code wants to be assured by me as soon as I do something on the construction site.

Is it similar for you?
By what right they want to see our loan agreement, I couldn't understand either. We didn't send it to them and are now waiting.

No, we do not have such a situation.

I will first send the form with the information that we obtain loans from Bank X but no specific amounts. They should get back to us first.
