For us, the backrest was only max. 10cm "large." There were also families who had already placed curbstones or similar on their own property - and these were then removed (always only the last row).
They won’t need the 30cm but they will definitely move the backrest onto your property.

Of course, it is possible that the city has contractually been granted such a right, or via a building encumbrance, but the original poster would know about that, wouldn't they?

If you look, you'll find dozens of court rulings where such retaining walls had to be removed again. A very famous one from last year in Dortmund ended with a settlement..

There are definitely construction solutions that make such a retaining wall unnecessary on foreign ground. Just costs 3 Marks more.

You can put your quibbles where the sun doesn't shine; better yet, just refrain from them altogether! I’m sure it’s somewhere in his property documents and he just doesn’t remember at the moment — after all, Mother Nature has other concerns right now. With us, the street (except for the final asphalt layer) was already finished before the first construction projects began.

The notarial contract also clearly stated that the back supports of the already set curbstones/edgings partially extend onto the adjacent properties.

I don’t know of any such right. Furthermore, there is no corresponding building encumbrance.

I know my documents.

Now I won’t push it to the limit.

Instead, I’ll try to manage the entrance and the few centimeters that need to be removed with a cold hop beer. Otherwise, I don’t care whether these supports are on my property. The way communication was handled with two weeks’ notice drove me up the wall.
