It drifts into off-topic, but as long as he pays child support, it is no longer a shared custody arrangement, then there would be nothing against the re-registration.
He pays no child support either, with the reasoning that we would both take care of the children equally. Incomes are now relatively similar, except for his housing benefit (paid-off house).
If he does not agree, the only way is through the court. The court could grant me, upon application, the sole authority (the term is not quite correct, I didn’t remember the technical term) to determine the place of residence.
Even if he would not take care of the children at all, I still could not register them without his consent.
Sorry, I didn’t mean to hijack the thread. But I am a bit annoyed about how the rules are... someone can apply for the [Baukindergeld] for "other" children (even though the parent has no share in the property and only lives there) and I get nothing for my own, because of such a formality standing in the way. The children don’t spend a minute more or less here or there just because their main residence on paper is here or there.
