I don’t understand. You go up an open staircase to the attic (also open) and there you have about 6 sqm seating area with a window in standard design and from there a door in a different design leads to the roof terrace.

The OLG Düsseldorf ruled under the case number I-21 U 23/14 that an entrepreneur cannot generally rely on their right to refuse if it only concerns a cosmetic defect. According to the judgment, they must remedy the defect, even if it only involves cosmetic impairments. It would be different if you yourself have little interest in the defect repair and/or the effort is disproportionately high.

Perhaps you could inform the developer accordingly. But before you involve a lawyer right away, I would first try mediation. The chambers of crafts also like to assist in such matters.

The shape of the windows differs because the usual windows are rather classic, country house style, stained brown and with muntins. And the two windows that are outliers are rather modern, painted gray and without muntins.

And you only notice this fundamental difference now? Very surprising...
