Who bears the costs of asbestos removal in new construction on an existing semi-detached house?

Hello,

hope I am in the right subforum here.

We have purchased a plot of land in Lower Saxony on which we want to build a semi-detached house.
The neighboring half has been there since the 1980s. Our half has never existed before.

The party wall on the extension side is covered with asbestos-containing cladding.

Our question is, who has to bear the costs of the unfortunately not exactly cheap removal.
Us? The neighbor? Half and half?

Where can we find information about this?

Is your neighbor currently renovating his house and asking you to contribute half to the renovation of his panels, or why do you expect your neighbor to tear down his panels?

You want to extend, not him. That means if at all *he can* participate in my opinion but does not have to.

Why exactly should he pay for something if you want to get rid of the [Platten]?

I had already answered that: Essentially, this means your "homework" is to clarify on whose property his facade cladding "stands" and whether there is or should be insulation on his "unclad" wall beneath the asbestos panels. If all that stuff is on his side, you have no claim for removal, but it is probably not sensible for him to keep it under the new weather conditions. If only his bare (or possibly plastered) wall is on his land, you can revoke his permission to use your property for his cladding. However, it may make sense to install insulation for mutual benefit between the house walls and sacrifice corresponding centimeters of house width on your side for that. It was already considered progress at the time to have separate exterior walls of the halves also at the line of contact instead of a common wall. His exterior wall may even partially stand on your property, meaning your property is effectively already 12 cm narrower than in the cadastral plan.

You want something so you pay ... I drive a gas guzzler, my neighbor is an eco-friendly guy and drives an e-car. He also asked me recently when I would give away my 90s Mercedes. I said when the Lotto fairy comes or he sponsors me the new car!
