Hello,
I am still very new here and hope that someone can give me tips on my current problem.
Brief description of the situation:
We have an end terraced house (facing the street) in Hamburg. In spring we want to redesign our garden and need some deliveries of various bulk materials (topsoil, recycled concrete, gravel, etc.). The street is separated from our property by a roughly 2.5 m wide sidewalk. There is no lowered curb (but the curb is very flat, about 5-7 cm) and no parking bays. The path is about 50 years old and paved with old gray sidewalk slabs and some rough asphalt poured on.
The suppliers told us that we need a permit from the [Wegewart] to drive over the sidewalk due to possible damages. Our gardener (a friend) said it is common either to pay a fee of about 600 € for this permit. The other apparently quite common method is to deposit a security of about 2,500 €, which the authority can use for repairs if damage occurs.
Now the [Wegewart] was here on-site today and said a provisional driveway is necessary (sidewalk will be dismantled, asphalt poured so that no curb edge needs to be overcome, and in the end the driveway will be removed and the sidewalk relaid). So far so good.
BUT THAT IS SUPPOSED TO COST 5,000 €!!!
That means we are supposed to pay 5,000 € without having caused any damage at all!
We are pretty stunned. Wouldn’t it be much more reasonable to settle the matter with this security deposit? After all, we are just a private household and have saved hard and long for the house and the new garden. 5,000 € is really steep. We recently already paid 500 € to the authority so that we can build our small garden shed under the tree (it could be damaged according to the green department). I already found that cheeky, although I am a true nature lover. Others buy a garden shed for 500 €.
Well, the thing with the shed actually doesn’t matter here, I just wanted to mention that it’s not like we shy away from any fees. But 5,000 €?
Now the question: Does anyone have a tip for us? Who can one contact here or does anyone perhaps know of similar cases in Hamburg?
