why penalty payments?!
Entrepreneur 101:
- you get commissioned to dispose of soil
- you collect the disposal costs
- by chance, you have a few projects, possibly larger ones in the area and have the soil to be disposed of delivered and incorporated there (provided the excavation can be used for that)
- so you have collected twice, this happens very often in practice
- even better is to take away the entire excavation, because supposedly there is no space on the property (expensive disposal) and then have it delivered back by the same entrepreneur for filling (paying dearly)

Entrepreneur basics:

- You present the builder with an invoice for the disposal of X m³ of excavation. The builder is requested by the lower environmental/waste authority of the state to provide proof of disposal for his excavation. He submits the excavator’s invoice. The builder’s problem is thus solved. How it proceeds from there is no longer of interest.

And ACTUALLY, one of the neighbors here was asked to submit proof of disposal for his construction road...
