Walk-in garage on property boundary

Hello,

I am new here and first send a friendly hello to everyone.

I registered here because I have not yet been able to find a clear answer to a question of mine.

You are allowed to build garages on the property boundaries!?
Are you allowed to make these garages accessible / terrace on the roof?
If yes, what must be strictly observed?

I would be happy about many informative answers.

Hello Jochen,

yes, you are normally allowed to build garages directly on the boundary.

However, you must note that the maximum boundary construction may be a total of 15m and a maximum of 9m in one piece.

With a terrace on the garage, the distance spaces to the neighbor usually have to be observed.

A building application must be submitted. The authority must approve the garage.

Short and concise: Usually triggers distance easements (3m) and open space easements (5m).

I also once researched on the internet some time ago because my neighbor had been considering the idea of retrospectively building a roof terrace on his garage for his tenants.

If the garage may be built on the property boundary based on a special regulation bypassing the usual distances to the neighboring property (which is often the case), to my knowledge it may only be used for this purpose (as a garage). Converting it into additional living space, converting the roof into a roof terrace, etc. would be an unauthorized change of use and would thus invalidate the building permit.



One is generally allowed to build an elevated balcony above the garage with the usual distances to the neighboring property, so not right up to the boundary (usually 2-3 m distance?). Direct use of the garage roof is generally not readily possible. In any case, a building permit is required. Whether neighbor approval can override the legal regulation, I do not know either; but I consider it unlikely.

I don't know about mere consent, but possibly a building encumbrance registration? As a neighbor, I would think about it three times or have it appropriately compensated...
