Update Construction Contract - Listing Increases as PDF

I regularly receive a PDF with the increases that I have confirmed via email. The whole thing is called Fortschreibung Bauvertrag. So far, I actually found it quite serious.

Recently, the site manager called me and mentioned a drilling that is still needed. It was supposed to cost €250, I agreed to it, it’s not a big amount anyway.

Now, in the Fortschreibung Bauvertrag PDF it says - drilling (telephone agreement) €250. I don’t want to get upset over €250 but honestly, in hindsight I found it a bit annoying.

At the bottom it also says if I do not file an objection within 6 days, it is considered confirmed.

Is something like this legal?

I think that is basically a good process that you both probably agreed to beforehand. It goes without saying that you should check the increases carefully. I don't quite understand your question at this point. Is it about the 250€ for a drilling (which one, what, why?) or generally about the phone call and thus the short notice? Sorry if I'm not quite keeping up.

It was about the fact that it was done over the phone and I have the feeling that it’s not for the drilling. I was kind of a bit annoyed but actually I shouldn’t be. It’s only 250€.

If I understood correctly, you now have 6 days to look at this drilling. If it doesn't exist, you shouldn't make any advance payments. Write a short email and say you weren't fully attentive on the phone and wanted to ask again what purpose the drilling serves.

I find it at least the relatively best possible way to deal with your situation. Because when I look at your thread , Reinhard Mey comes to mind: "and it goes like this, as I suspect, until I am a hundred years old" ;-) The path of building with a general contractor without tender and with an included planner, who starts in third gear and more or less compresses service phase 5 into construction drawings, inevitably leads to "learning by doing" with a veritable ever-dribbling stream of change orders that remarkably and surely pull more money out of your pocket than the construction with full detailed planning would have cost. The builders who don’t want to believe that beforehand never die out, but lose more nerves and not less money in the process of building their house.
