Tree in the building window, rotate the house

I am currently in the process of submitting a preliminary building inquiry, and now I have a problem with the building window. Due to 2 trees that stand very unfavorably on my property and for which I unfortunately do not receive a felling permit from the City of Hamburg, although at least one tree is within the building window, I intend to rotate the house and build 12 m deep x 15 m wide instead of using the building window of 12 x 23 m (minus boundary distances 12 x 17 m) which I cannot use. That means I would be 3 m outside the building window on one side. The property has a size of 23 m wide x 32 m deep. Does anyone know if I need to obtain permission from the neighbors (all 4 neighbors? since it is a flag lot) and if so, does anyone have an idea for a wording. Thanks for your answers Buddy

Hello buddy,

basically it is possible, but it is a task for AR/surveyors. I can put you in touch with a colleague in Hamburg who can usually explain to you in 5-10 minutes – with the corresponding plans – whether your idea is feasible and what additional costs will arise.

Hi,
such a building boundary does have some purpose after all. That's why it probably only works through an exception that has to be granted to you. 3 meters outside the building window is already quite a figure.....how about the specified ridge direction?

No, a ridge direction is not specified. The main problem is 2 trees for which there is a kind of tree protocol stating in what good condition the trees are; otherwise, none of this would be a problem. I am also willing to provide replacement planting or payment. But the nature conservation office does not want to negotiate, although 13!! trees from the neighboring property still stand at the border to my property. I have an architect, but I am also trying to do something myself.

If an AR is already involved, he should ensure that the building preliminary inquiry is formulated sensibly. It's not rocket science, but it also makes no sense to invest work in building preliminary inquiries that will be rejected anyway.
