Hi there
I am not a lawyer, but to my knowledge:
A contract is concluded when two identical declarations of intent are present. (universally valid - not dependent on the written form)
With an order, I make my declaration of intent, and with the AB the other party makes their declaration of intent.
It is the same when both sign the same contract. Then both parties have made their declarations of intent, and since it is the same contract, these declarations are identical.
