Too high price in the contract

Hello, in our construction contract for a DJH I noticed that our GU recorded the price incorrectly. We had calculated different house sizes and the contract states the price for the larger house which we are not building. Does he have to adjust this? Thanks

Contrary to my predecessor, I do not see that the general contractor [GU] must adjust the price; especially not if the order confirmation has been issued and is identical. This means a legally valid contract - in this case probably a contract for work and services - has come into existence.

You have two alternatives to choose from: The GU is reputable and will likely correct the "mistake," or you terminate your contract. In the latter case, however, you do not get out of the contract free of charge unless you have agreed on a corresponding right of withdrawal. The amount of damages is determined by the contract; in any case, you must pay the GU for the services rendered so far. A lawyer you trust will be happy to advise you in the worst case, because in the Federal Republic of Germany, the relevant law is reserved exclusively for the advising professions.

What I do not understand, however, is this: You have probably undertaken the biggest investment of your life and do not even look at the amount at the bottom right – not even once? Financially, you must be doing very well... :rolleyes:

Is it always the case that the general contractor must send an order confirmation when concluding a contract for work? I signed last October and still have no order confirmation?!
