Hello, in our construction contract for a DJH I noticed that our GU recorded the price incorrectly. We had calculated various house sizes and the contract includes the price for the larger house which we are not building. Does he have to adjust that? Thank you

Have you already signed? If yes: Dude, you look at such numbers 15 times... If no: He should change the contract.

he has to change this. If you have already signed, I would ask if a mistake has been made or why the price is different. If he leaves you in the lurch, then pull the emergency brake right at the start and threaten to withdraw from the contract.

Contrary to my predecessor, I do not see that the GU must adjust the price; especially not if the order confirmation has been issued and it is identical. This means a legally valid contract - in this case probably a contract for work/services - has been concluded.

You have two alternatives to choose from: The GU is reputable and will probably correct the "error" or you terminate your contract. In the latter case, however, you will not get out of the contract free of charge, unless you have agreed to a corresponding right of withdrawal. The amount of damages is determined by the contract; in any case, you must pay the GU for the services rendered so far. A lawyer you trust will gladly advise you in the worst case, because in Germany the relevant law is reserved exclusively for legal professionals.

What I do not understand, however, is this: You have probably undertaken the biggest investment of your life and don't even look at the amount bottom right – not even once? You must be doing very well financially .... :rolleyes:

Is it always the case that the GU must send an order confirmation upon conclusion of a contract for work and services? I signed last October and still have not received an order confirmation?!

If there was no "confirmation of the order," then actually no valid contract was concluded. Unless the order and the order confirmation are the same document.
