The developer does not disclose craftsmen

Hello everyone,

our developer (based in Fürth) refuses to name the craftsmen companies; we were told that we will be informed about the company one week before the start of the work.

Is the developer allowed to withhold this information from us?

I suppose that your provider does not yet know who will carry out the work and therefore cannot/will not provide information.

When will the work begin?

but all the craftsmen are fixed,

when the work will be done is not foreseeable, sometimes nothing happens for weeks then it goes on again (there are 40 terraced houses).

Occupancy is 30.09.

for us it is about whether they can refuse you this information

probably they want to prevent contact, but from our point of view it is urgently necessary, because a lot has gone wrong so far.

The contractual partner is exclusively the general contractor/main contractor (GU/GÜ), not the respective subcontractor of an individual trade. All questions from site management, coordination ... are also the responsibility of the GU/GÜ. It is therefore at their discretion whether to pass such information on to the client.
From your point of view, maybe sensible or necessary; the GU/GÜ apparently assesses this differently based on their interests.

€uro has already given the correct answer; the first point of contact is your contracting partner. If he has guaranteed you the disclosure of the craftsmen in writing, you will have to wait; only he alone knows when the work will begin and must fulfill his contractually agreed duty to inform.

Something does interest me, though. If it hasn’t started yet, what has already gone wrong? And – have you already informed your contracting partner of this in writing?

As a client, it is naturally your right to know the providers; here is what a client represents.

The performing party client is a person or organization. They make the entrepreneurial decision to plan and execute a project and assume the duties and rights arising from this decision. According to Art. 73 of the Bavarian Building Code, cited by Schub [3.7], the client is "someone who prepares or executes a building structure on their own responsibility, or has it prepared or executed."

The client thus defines the building task in terms of scope, quality, time, and costs, acquires the land and financial resources, commissions planners, companies, and suppliers, and fulfills the requirements for a largely smooth construction process by obtaining the necessary permits and making timely decisions in the various planning and construction phases.

Furthermore, they coordinate the activities of all parties involved in the construction and, after the planning is completed, which takes place in the individual partial steps through feedback or control loops, supervise the execution regarding quality, time, and costs. From the perspective of efficient construction execution, they have the special responsibility to ensure that all construction services are carefully planned and tendered, that the companies receive the necessary execution documents (plans) on time and in full, and that the necessary decisions on their part are made promptly.

This presupposes knowledge of the providers.
