Taking possession before gift / usufruct / renting - disadvantages?

Yes. Should/wants and is allowed to. But initially without rent and without a rental contract. Just move in, register the residence, simply just live there for now. The child is coming back from abroad and needs a place to stay. Why rent from outsiders when the apartment is there and empty, ... that's the background.

Yes, they do. Gladly also in 1.5 or in 2 years. But in the foreseeable future, yes. As a second home in a very rural area.

Just asking stupidly: What is the whole nonsense with donation, usufruct, and all the other stuff supposed to be for? Apart from pointless costs, it doesn’t create any added value. Why are you doing that?

Oh. Isn’t usufruct a very common and frequently used procedure? It reads now as if it were totally exotic.

The ideas were:


    [*]Gift during lifetime (allegedly many people do it this way)


    [*]Usufruct, because the apartment is still intended to be used by the donor themselves in the horizon of 1-3 years


    [*]"The surroundings", what exactly do you mean?

It actually is. Usufruct has absolutely nothing to do with use by the donor. You have no right to that. That is solved with a right of residence. Around it = free use, gift, rental, own use, notary fees for everything, non-pledgeability for the bank (provided usufruct takes precedence). You still haven't said why you really want to do it.

A usufruct occurs more often with farms in the course of anticipated inheritance, with your construct I would rather have thought of something like a right of residence.
