Is the construction company directly or even just indirectly responsible for the damage? Are there any indications of inadequate securing of the construction site? Do you know the subcontractor's contract? Because I don't... I am only pointing to one possibility if the construction company refuses to cooperate.

Sorry, I don't want to offend you, but I really had to laugh – this isn’t about a hidden camera, is it?

How are 10-20 stones sized 3-4 cm supposed to cause a detectable defect on the concrete slab over an area "x"? At most, the slab might have a small dent where the stones hit. If some actually "got stuck," of course it depends on how deep the dents left behind are and whether – after removing the pebbles – any rework is necessary or required.

It’s not like the concrete slab, without any further construction, serves as a walking surface for your ground floor. Just think about what all builders embed in the slab or animals that jump over the concrete after completion. For example, I have found nice paw prints from both cats and dogs at various construction sites.


Not by the builder’s liability insurance, but probably by the construction all-risk insurance; it depends on which of you two is required to have this insurance. Since you write below that you took it out, your prefab house supplier is probably not involved, as it does not seem to be part of their owed service. Clarity is provided by a look at the contract for work and supplies, or the general terms and conditions.

But before you get the horses scared, ask the concrete worker what he thinks of your stone mosaic

Exactly! The word "provided" makes the difference. If the prefab house supplier does not contractually owe the construction performance insurance at that moment, the builder is left with the dents. Unless he himself has taken out a corresponding insurance, which apparently is the case for the OP.

You should be more cautious in dealing with hasty judgments. First and foremost, the contractual situation should be clarified before rushing and, following a well-known pattern, criticizing the supplier, who may have prematurely raised false hopes for the OP. Moreover, here it is about small dents, not the absence of several kilos of steel per square meter!

And finally, something to think about: on the one hand, judgments are pronounced in German courtrooms, NOT justice. On the other hand, it should not be assumed prematurely that once passed judgments must apply to every roughly comparable case.

First of all, thank you very much for the many responses! Most of it is probably not that bad. But in one spot, where a wall will also be placed later, it is more than just a small dent. Something definitely needs to be repaired there.

If I understand everything correctly, my [Bauleistungsversicherung] should cover the damage?
