Setback distance from own field ground?

Hello everyone,

I would like to start building a single-family house next year. The house will be built on the edge of the district (Upper Bavaria) on my plot of land on a slope.

The field next to the property belongs to me but is located in the outer area.

Which setback distances do I need to consider here? The desired building height will be approximately 10 meters (ground to ridge). Can I also transfer setbacks here or are there possibly different regulations to follow when building on the edge of a town?

The distance area regulations became even more complicated in Bavaria by 1.2.21 at the latest, since each municipality can set its own rules. Assuming that this is not the case for you and the rules of the BayBO apply, you must maintain a 4m boundary distance for a building height of 10m. With a distance area takeover declaration, you could also build directly on the boundary according to building regulations. The BayBO does not distinguish between external and internal areas in this regard. Whether this is permitted according to planning law is decided by the authority on a case-by-case basis, because the external area boundary does not have to coincide with your property boundary.

And in some cases, the building authority can also completely waive the setback areas to the (own) outdoor area due to discretionary powers. This was the case for us, as meaningful construction would otherwise not be possible, it is a densification in the sense of the municipality, and in the village in the outer area no construction is ever allowed in the second row. Only a building inquiry helps here.

We had to generally observe setback areas to our forest property, but after consultation with the building authority, we were able to shift the building envelope 1m towards the forest and construct the carport outside the original building envelope. We personally presented a draft plan at the building authority and worked out the solution together. Great people in our district, they do not just allow everything and at the same time have an interest in the well-being of the builders.
