Seat cover - building application?

We are planning a covered seating area. Somehow I once heard that you only need a building permit if you enclose the roof. We would like to just build the framework first and then submit a building application because we are not yet sure how best to attach it to the house. The municipal regulations do not mention anything like that, the building administrator is not sure, and I can’t find anything about it on the internet either. We live in Aargau. Thanks for tips

Hello Neela,

Whether the roof is closed or not probably has nothing to do with it; as I understand it, every building, every installation, etc. that is firmly connected to the ground requires a building permit. Your "scaffold" will be considered an installation in this sense.

In the Law on Spatial Development and Construction (Building Act, BauG) of the Canton of Aargau, it states in paragraphs 59ff that all buildings and installations and their significant alterations, expansions or changes in use with regard to concerns of spatial development, environmental protection or building regulations as well as the removal of buildings require approval by the municipal council.

However, the municipal council can approve construction projects that do not affect neighboring or public interests, after written notification to direct neighbors without conditions, publication, and profiling.

The approval of the construction of your patio roof will therefore not be complicated.
