He wants to build on the boundary, but exceptions for distance areas to boundaries are dealt with in paragraph 10, and saunas do not fit into any category there, so a solution is needed for the distance area(s) located on the neighbor(s)' property(ies).

Awesome, you guys are really great. Super informed. I’m trying to get something in writing from the building authority so the neighbor can sleep peacefully. He also kept starting again with 30m3. Maybe he’s confusing something. Yes, the building authority gave us a sentence for the approval. It says approval now and for every legal successor. That means if it is ever sold, the approval continues. Well, according to the building authority...

In the case of an extension building encumbrance, there can be no clearance area at all.

Now that's enough. First, you claim the sauna isn't a building at all. Then you quote a paragraph from the HBO without comment that has nothing to do with this case, and now you present the attached encumbrance as a given. The building authority obviously wants to enable the construction of the sauna as simply and cost-effectively as possible without encumbrances. Just admit that you were wrong in #11 and that #13 was pointless. The attached encumbrance would be an option if the neighbor still doesn't want to sign after the discussions. However, the sauna would then have to be equipped with a firewall and additional fees for registration would apply. Presumably, higher requirements would also be imposed on the building documents. But we are not that far yet and it was not the OP’s question.

Just because you don't understand a law doesn't mean others don't understand it.

Even with a subsequent cultivation easement, the neighbor must agree. That's why I write that the OP can show such an advantage for the neighbor, because it would be an advantage for the neighbor.

A sauna can be built on the boundary just like any other wooden garden shed.

In Hesse, there is no further effort; the building authority itself usually has nothing to do with the list.
