Sanitary heating company problems - Is it allowed to decide autonomously?

Hello everyone,

we are building a semi-detached house through an architect. Contractually, various trades with different standard executions (extra costs for special requests) have been agreed upon. Now one of our problems: We have read experience reports and consumer documentation about the two heating manufacturers (I don't know if I am allowed to name them :)) that our plumbing company offers and found significant discrepancies; in other words, one manufacturer performs significantly worse and is absolutely not recommended!

I contacted the plumbing company by email and clearly expressed (without much negative explanation) which heating system we want to have installed.

A similarly brief email came back stating that it is solely up to the plumbing company which heating system is installed! I have not responded yet because I find this more than cheeky and I would like to ask more experienced home builders how I should deal with such a statement. And whether this is even legally permissible. I would be very grateful for any advice.

I think
a) the heating system you want will be installed as a courtesy – within the planned costs
b) ignores what you want – after all, you signed

Can't you speak with the plumbing company personally? I find this automated response quite cheeky.

I'm interested in the manufacturers. I will need a new heating system soon as well. I can't imagine that certain models/companies are really rubbish. Keep in mind that information from the internet must be heavily filtered and interpreted. Usually, only people with negative experiences speak out. More negative reports can also mean that the manufacturer is installed particularly often and problem cases always exist and don't necessarily have anything to do with the manufacturer.

Is the sanitary trade also included in the purchased standard? Is there a written note that you can upgrade for an additional charge?

There have already been various other problems with this plumbing company, surcharges for special requests that were absolutely incomprehensible, including 3500 euros without VAT for 2 shower cabins plus 350 euros each for installation, surcharges for washbasins that only had a different shape of 250 euros, 27 euros were charged for the standard washbasin... which, however, is sold for 155 euros and all such things... with 2 bathrooms and a guest WC that already adds up to quite a lot of extra costs...
I have already called through all instances, up to the boss :mad:
That’s why I absolutely don’t want to exchange even a single word on the phone anymore.
The gas heaters are either made by the company Brötje or Elco.
We would choose Brötje, they performed better.

Otherwise we are quite satisfied with the other trades, only this one is really a tough nut to crack.

Hi Bauexperte,


yes, the trade sanitary, sanitary equipment, heating and solar are included.


It is not documented in writing regarding special requests, but before each sampling, this is verbally offered to us, usually with the question: How much would you like to spend additionally for your (trade)?

You might be right.

I think our trust is completely gone now because of this company's exorbitant extra prices.

Maybe we are also reacting too sensitively, but we have actually heard more negative headlines about Elco; Brötje is rather perceived as satisfactory. (It will be a gas heating system ;) )
