Hello,

The plot of land we want to buy is on a slope and has a road above it. However, this road only touches the plot for a length of about 12m. Then the road ends for the time being and transitions into the meadow (entire development area).
The development area is divided into two phases. Phase two is not supposed to start until most of the plots in phase one have been sold and developed. The aforementioned road is also only to be extended as part of phase two.
Connections (water, electricity, gas) can/should be made via the section of the road. Since the house is to be built at the back part, we have to lay the connections on our plot somewhat longer than just perpendicular to the road.
About 50m further down the slope runs another road, roughly parallel to the upper one. The lower road has now been extended as part of phase 1 and is about as far along as the upper road. In phase two, both roads in the further part of the development area are to be connected to each other with a slight serpentine.
Due to the slope location, we are supposed to drain rain and greywater downwards. For this, we need to lay a corresponding pipe downwards across the neighbor’s plot to the road located there. The routing across the neighbor’s plot will be regulated notarially in a separate contract together with the neighbors (who are buying simultaneously) along with the purchase agreement.
For this measure, we then share a manhole with the mentioned lower neighbors, to which we both connect and which is then connected to the municipal sewer located there.
For this, the city has already laid a sewer pipe to the corner of the neighbor’s plot. Costs of about €3,000 will still be invoiced for this, which we are supposed to share with the neighbors.
Summary again:
- I have to order and pay for the development from above myself
- the upper road will not be extended for the time being
- we also have to pay for the drainage downwards ourselves
Now to my question:
If one day the final development for phase two takes place, which costs of that will we have to share?
From my point of view, I would say that any further sewer costs should not concern us, as we have already paid for the measures.
Which part of the road in the final development do I have to share? That of the entire area, i.e., also the part of the lower road, or only the 22m where my plot is not yet bordering the road?
Or could it also happen that for every section that is built gradually, we are asked to pay step by step as well?
And if so: wouldn’t those who have already built before me also have to contribute to the measures specially constructed for us?
I spoke on the phone with the gentleman from the city on this topic.
His first statement was: As it stands now, everything is uncertain when phase two will begin; it ultimately depends on the seller/owner of the development area.
Regarding the sewer contribution, he said it would be nonsensical if we had to co-finance the further sewer expansion; that would not be imposed on us.
However, he did not want to give me this in writing as a matter of principle.
I’m now a bit uneasy that in 5 years contributions might come up that do not concern us and that we will pay twice for the preliminary and also for the subsequent measures.
What is your opinion on this and what could I do in advance before purchase to better secure myself there?
I already have legal expense insurance, but I actually did not want to contact them even before the purchase.
