Report of construction defects, no response, next step?!?

It is a very large garage company operating nationwide in Germany, the name is gladly provided via PM, as they have already issued me a warning because of a bad review. The fact that they do not finish the garage is a spiteful reaction to an impending lawsuit on our part. It concerns another contract that they cannot execute as ordered, but want to keep the down payment as a planning fee.

You are still in the manufacturing phase as opposed to [Gewährleistung]. To my knowledge, you cannot just hire someone else now according to the latest laws. You must set a deadline for fulfillment that is reasonable. And if this expires, you can withdraw from the contract (bad because then you would have to return everything), claim damages (I don’t think you have any damages). Unfortunately, you are still in this first phase until acceptance and you can only get out of it by declaring acceptance (here I suppose with reservation)... only then can someone else be commissioned.....

Withdrawing from the contract is hardly realistic. Set a deadline and declare a reduction of the invoice after it expires.
