Purchasing a vacant lot, what should be clarified before buying?

Hello,

I have been reading along in the forum for quite a while.
Now we have found a plot of land (developed) that we like through the Baulückenkataster. We are already in contact with the owner regarding this.

According to §34 of the Building Code, construction is permitted; it is a narrow, long plot with a south-facing slope (approx. 500 sqm). I have attached a section from the Geoportal Bayern with plot boundaries (the area marked in red is it).

I have the following questions beforehand and am not quite sure how and to whom one should turn.

- The plot was developed in the early 70s and has since remained fallow
- Surveying data, do I have to request and pay for it at the building authority?
- Soil report is not available
* I have already read in the forum that it is sensible to have one done before purchase, or to ask the neighbors.

According to §34 in Bavaria, I have to keep a distance of 3m, garages not (if approved). Now there is the following peculiarity:
The plot is built up on the right side (from above) up to the property boundary with a house, no windows on that side of the neighbor. Can I now assume (building inquiry, neighbor?) that a construction project will also be approved so that I may build directly onto the neighbor’s house?
I ask because with a 3m distance, more space would be lost due to the narrow plot, and meaningful construction would no longer be possible. (There are 8m left to the left property boundary, minus 3m distance would be 5m…).

Since we would like to clarify this before purchase, what is the best way to proceed, because buying and then finding out that direct building is not allowed would be expensive and useless.

Hello

you can build directly onto the semi-detached house. You will probably have to adopt the height and width of the neighbor. Possibly also the house shape.
Otherwise, the boundary development of your neighbor would not make sense. On the other side, you have to maintain the setback area.

Alternatively, it could of course be that a distance easement is on "your" property... Then you would even have to maintain a 6m distance...

In any case, take a look (or have someone take a look) at the register of easements.

Yes and no. Even if the distance area easement were inactive, it would have to be removed if an extension is built as prescribed onto the existing house (closed development or adaptation to the surroundings). If not, the property would be almost worthless.

: but you can find out quickly by simply calling the building authority or—if you already have one—the architect.
