Hello everyone!
Is there actually a definition of the term "public funds" when it comes to financing? The conditions of the leasehold agreement are as follows:
"If public funds flow into the financing, the value of the mortgage lien can be up to 100% of the total aforementioned construction costs plus development costs and acquisition costs of the leasehold."
Now I'm wondering: Are funds from KFW included in this? A phone call with the notary who drafted the contracts didn’t really help. I was only told: There are no further restrictions... but whether that exactly falls under public funds cannot be said here, that should be known by the financier. The financier had previously referred me back to the notary to ask again... great!
I think the funds from KFW are included... but my thoughts won’t help much when it comes down to the wire. Do you have more experience with this?
