Hello everyone,

I have been a lurker on the forum for a while now, but I finally have a question:

We are about to purchase a building plot in a new development area directly from a municipality and have now received the draft of the purchase contract. This includes an easement for the property regarding wastewater pipes and shafts running along the edge of the property (both on the south and east sides).

A protective strip with a width of 4 meters is provided for this, which must not be built on or planted if access is impeded or the pipes are affected. Building is not possible anyway, as the area lies outside the building window.

What I’m not clear about now ... Can a fence be erected at the property boundary? Or must it be constructed outside the protective strip? (which would significantly reduce the property size). What about a hedge in this case?

Pure layman's opinion:

If there is something wrong with the line, then the excavator has to be used, regardless of whether there is a hedge or fence there. Even if you were allowed to build the fence around the 4m strip, you would have to ensure access, otherwise you would be "impeding access".

The easement is registered in the land register. However, this includes a permit agreement that regulates the details. Have the easement and the permit agreement shown to you!

In my permit agreement the following is stated about the protective strip:

The strips of land marked in the layout plan mentioned here on both sides of the pipeline axis (hereinafter also called protective strip) may not be built on, overlaid, nor planted with trees, but, with the exception of existing horticultural installations - only planted with shallow-rooted plants. Exceptions to the prohibition also include a gate system, the fence consisting of fence posts that are concreted to a depth of up to 50 cm, paved and waterproof traffic areas, pathways and driveways including drainage channels.
