Hello everyone,

the following situation. We have very precise ideas about our bungalow. My husband has already drawn a plan, entered all dimensions, and transferred it into a PC program. He is a bricklayer by trade and wants to build the house himself.
How can we arrange it so that an architect costs us as little as possible?
We have heard that a master craftsman from the construction industry can also put a stamp and signature on a building plan?
Which guidelines must be observed? For example, regarding the low-energy standard?

To my knowledge, trained draftsmen are also allowed to sign a submission plan (building application). For the construction project (and the district office?), you also need a structural calculation - or do you want your house to collapse?

Hello,
to submit the building application, someone must be authorized to submit building plans.
As far as I know, these are usually architects and, if applicable, civil engineers.
You should clarify this in advance.

Bavarian Building Code (BayBO)

Art. 68: Authorization to submit building applications and provide proofs

(1) Building applications for construction projects requiring approval or for those to be dealt with according to Art. 64 regarding the erection and alteration of buildings must be signed by a designer authorized to submit building applications.

(2) Authorized to submit building applications is

1. anyone entitled to use the professional title "Architect" based on the Bavarian Architects Act, or

2. anyone registered in the list of authorized engineers according to Art. 20 para. 2 of the Bavarian Chamber of Engineers Act for Construction.

(3) Also authorized are members of the disciplines architecture, structural engineering, or civil engineering who have successfully completed their studies at a German university, a German public or state-recognized engineering school, or at a German educational institution of equivalent standing, as well as state-certified technicians specializing in construction engineering and master craftsmen in the construction and carpentry trades for

1. residential buildings with up to three apartments each, also in the form of semi-detached houses, unless these are housing groups where the third apartment is located on the first level of the attic,

2. single-story commercial buildings with up to 250 m² floor area and up to 12 m clear span,

3. agricultural buildings with up to two full stories,

4. garages with up to 100 m² usable area,

5. temporary structures and outbuildings,

6. greenhouses,

7. simple modifications of other buildings.

Diplomas, certificates, and other qualification proofs announced under Art. 7 of Council Directive 85/384/EEC of June 10, 1985 (OJ EC No. L 223 p. 15) as well as the respective proofs under Art. 11 or 12 of this directive in its current version and diplomas within the meaning of Art. 1 letter a of Council Directive 89/48/EEC of December 21, 1988 (OJ EC 1989 No. L 19 p. 16) for members of the civil engineering discipline as well as proofs of education within the meaning of Art. 3 letter b of Directive 89/48/EEC for members of the civil engineering discipline, are considered equivalent for nationals of another member state of the European Union or of another contracting state to the Agreement on the European Economic Area, insofar as the profession has been actually and lawfully exercised in another member state for at least two years within the ten years preceding the submission of the building application.

(4) Authorized to submit building applications is also anyone who

1. within the limits of their field prepares building applications which are usually prepared by professionals with a different training than those named in paragraph 2,

2. possesses the qualification for the higher or upper technical building administrative service for their activity for their employer,

3. is allowed to use the professional title "Engineer" in the fields of architecture, structural engineering, or civil engineering, has worked as an engineer for at least three years, and is an employee of a legal entity under public law, for their official activity,

4. is allowed to use the professional title "Interior Designer" for structural changes to buildings associated with the professional task,

5. has successfully completed a degree program in timber construction and interior finishing that the State Ministry of the Interior has recognized as equivalent to training under paragraph 3 sentence 1 including the requirements based on the Ordinance under Art. 90 para. 11, for projects under paragraph 3 sentence 1, provided they are constructed using timber construction.

(5) Anyone not fulfilling the requirements of paragraphs 2 to 4 is authorized to submit building applications if, in their full-time occupation between October 1, 1971, and September 30, 1974, inclusive, they have prepared building applications as a designer or had them prepared under their responsibility, signed as defined in Art. 67 para. 4 sentence 1, and submitted to the competent authority in the Free State of Bavaria, and if these requirements have been proven to the competent authority within the exclusion period of one year from July 1, 1978. The authority issues a certificate about the result of this examination. The competent authority is the government district in which the applicant has their residence or business establishment.

(6) Companies may sign building applications as designers if they prepare them under the direction of a person authorized to submit building applications according to paragraphs 2 to 5. The name of the authorized person must be indicated on the building applications.

(7) The authorization to submit building applications, other than that according to paragraph 4 no. 1, includes the authorization to prepare proofs for structural stability including the fire resistance of load-bearing components, preventive fire protection, sound insulation, and thermal protection (authorization to provide proofs), unless otherwise specified below; this authorization exists only within the framework of the respective authorization to submit building applications. For projects of low difficulty, proofs for structural stability including the fire resistance of load-bearing components may only be prepared by

1. architects and civil engineers with at least three years of continuous professional experience who are listed in a register maintained by the Bavarian Chamber of Architects or the Bavarian Chamber of Engineers for Construction,

2. state-certified technicians specializing in construction engineering and master craftsmen in the construction and carpentry trades, if they can prove at least three years of continuous professional experience and possess the additional qualifications specified by legal ordinance pursuant to Art. 90 para. 11,

3. authorized persons in the sense of paragraph 4 no. 5.

For projects of medium difficulty, proofs for preventive fire protection may only be prepared by authorized persons according to paragraph 2 and paragraph 4 nos. 2 to 4, who

1. either

a) have at least ten years of continuous professional experience, or

b) provide evidence of the required knowledge of preventive fire protection through further training accompanied by proof of performance by the Bavarian Chamber of Architects, and

2. are listed in a register maintained by the Bavarian Chamber of Architects or the Bavarian Chamber of Engineers for Construction.
