First, have the gift notarized --> Gift tax officer arrives and wants to be paid Then subsequently demand consideration --> conditions for real estate transfer tax are met...the 2nd tax officer arrives.

In the end, the tax office may also get involved and want details....

Nowadays, with people like Höhne and others, tax evasion is assumed much more quickly than it used to be.

It's a pity that my question was not answered. I was actually in the same situation: my husband left and I stayed in the house. However, there was neither a gift nor a sale of any ownership shares. The equity invested by the husband was paid out, and there was no profit from the three years we were together, since almost only the loan interest was paid monthly and the repayment was too low. The notary removed the husband from the land register, which was still relatively inexpensive – property tax was not mentioned at all. At least, that's how I remember it now. So I would choose an easier way than the ones mentioned ;)
