Paving works - What rights/warranty do I have?

Hello everyone,

We have been living in our new build (semi-detached house) since December and had the builder lay paving stones in anthracite 20x20cm directly from the builder.

At the time of signing the contract, the builder was still working with a well-known company, but due to costs, they parted ways with the paving company and arranged for an alternative unknown company to lay our paving. This was okay for us at first because as long as it looks neat, we don't care who laid it.

However, we now have major problems with the paving.

When the snow melted after moving in, we noticed that the terrace paving had already sunk after 4 weeks. We complained about this, and the terrace paving was removed, the ground was newly prepared, and the paving was relaid.

Two weeks later, we noticed in front of and beside the house that the paving was settling there too and raising in other spots, and that we have isolated concrete/cement stains on the entire paving that cannot be removed. Also, along the entire garage, the first row of stones is heavily scratched over the whole length, damaging the stones.

The pavers then returned; we showed them all defects, and they fixed some of them during our absence, but not all.

This was 3 weeks ago, and the part they relaid during the last action has already settled again in one spot. The problem is that some stones have been replaced with new ones that are still really dark. The overall appearance is now very poor.

I reported all this again to the builder (third complaint). He said he would send his employee to mark everything and then replace stones and partly relay them. I already know it will look even worse than it does now.

The problem is that it was already mentioned in the original offer that stones of the anthracite color may have color differences/efflorescence. This was the case, but compared to the new/old paving contrast, it was hardly worth mentioning.

My question to you is now: does anyone know if I really have to accept this patchwork and these strong color differences, or (and from when) do I have the right to demand a complete renewal of the paving, possibly by the well-known good company from before?

the new stones will also fade, so that in the end it looks the same again. more important is that the surface is level and does not sink. a right to complete reinstallation due to discoloration (new stones) including completely new stones is disproportionate in terms of cost and the chances are close to zero. if at all, you would rather receive a small compensation payment. if at all, one could possibly exchange stones from elsewhere in the non-visible area against the new ones (e.g. if a shed or similar is standing on the stones). that could possibly still be proportionate. as said, it is first more important that it is technically sound. then there are no excuses...

agree with that. always thought stones stay nicely dark. no way. after 4 years nicely faded. but you won't see that in 2 years. worse are these depressions. what is that base material? was it not compacted? with us they shook like crazy

Yep - compact the substrate three times before laying and also at least twice with the vibrating plate after laying. If this does not happen, it will definitely settle. Even if the base layer (usually gravel) is not evenly high, causing the split/sand layer to be unevenly thick, settling will occur.

Or "do it properly" (or have it done). Compacted is compacted. But of course, if you have the time, you can treat the soil to it.
