I expressed myself incorrectly. The statements above come from the DISTRICT! I mistakenly called it the building authority...

In a few days we have an appointment at the building authority of our municipality, as it also has to approve the preliminary building request before it even goes to the district.

Fingers crossed for you, I am simply skeptical of any verbal statements by now, after our construction adventure ^^, we also live in a rural area.

When I look around our area, at such construction projects in the outskirts, at least 2 outer walls of the old structure always remain standing. This also aligns with the 50% statement. From my point of view, you won't get around that.

Acquaintances had a similar problem and solved it with us in Upper Austria by keeping some sheep. This way, they were also allowed to convert a barn into a residential house in an outer location. I don’t know if that would be possible for you as well.

If you could remodel, you would already be winners. My question was actually why the office should at all approve a residential building. Legally, it is excluded, unless you are privileged or have a cooperative office. If you are not a farmer, gravel pit operator, or similar, the usual answer is almost always: Nope.

That doesn't make it any better, as the district in such matters sometimes acts more realistically and result-oriented than the municipality itself, since it is not locally or emotionally attached but only legally obligated.

I can only repeat the advice to consult with a specialist lawyer beforehand: Not to start an unnecessary legal dispute, but to argue legally soundly in your own reasoning from the very beginning.
