Hello everyone,
a gardener has built a wall for us. The so-called Schwengelrecht states that the wall must be built with a 50 cm distance from the boundary if the wall borders agricultural land.
The gardener should actually know this. I also told him several times during the discussion. Unfortunately, he didn’t take it that seriously. On one side, there is now about 55 cm and on the other only 45 cm distance.
I foolishly did not expect that he would measure so inaccurately, nor that the farmer would be bothered by 5 cm. Both have occurred.
Unfortunately, the wall has already been paid as a first installment of further work. Another installment payment is still outstanding.
The gardener is basically a man you can talk to. He says, however, that he will not change anything because of 5 cm, since the boundary markers are inaccurate anyway.
The farmer is rather unwilling to negotiate/arbitrate.
1. How could the story theoretically continue? That is, regardless of what is sensible, what options are there?
2. And now: Which of these would you do?
