Land subdivision + house construction possible?

Hello everyone,

the following situation:

There is no development plan and the property is located in NRW.
Plot 280 (see attachment, marked in red) belongs to a very good friend, an elderly lady. The lady wants to enable us to build on the property. (She benefits because she can no longer take care of the property, etc.).
The lady lives in house No. 1 (also marked in red).

Would it be possible to divide the property in such a way that the lady keeps a small part of the property (where her house is located) and we acquire the rest?
Does the "new" property of the lady still need to have access to the street? She has a driveway to her house, which partially runs across the adjacent property (relatives) on the left.

Is certainly possible. 562, 563 have a higher building density. On a smaller plot (a part of the red marked area without house1) there will certainly be enough space for a single-family house.

There are often minimum sizes that a plot of land must have in a certain area (urban or rural infrastructure), even if no development plan exists (for us it is 650 sqm).

235 seems relatively small to me, the post office probably has a special permit ;)

I would best ask the responsible building authority.

A plot of land should have access to the street. I can’t imagine that a division can take place if the remaining land of the old lady would then lie like an island between other plots. But I don’t see a problem with the dividing line now, though I see your future house rather in the back part. Building encumbrances also seem to play a role here.

Thank you already for the answers. We also see our house more in the rear part of the property. What does the building encumbrance on the right actually mean for us? The neighbor’s garage is in the rear part about 2.5m on our possible property. However, we only have to stay 3 meters away from the boundary and not from the garage, right?

a subdivision is basically possible there, both new partial plots must have/retain a publicly regulated access to the public traffic area.
