The procedure can actually be observed in practice. There are also cases where the seller did not appear at the notary because he received a higher bid at the last minute, and the buyer is left with the notary costs for the contract draft.

Not appearing for the notary appointment after a confirmation is something different from what is described here. Such behavior is shabby.

From a legal perspective, that is completely worthless.

The legal perspective naturally looks different. For most agreements in life, the legal perspective is completely irrelevant for establishing reliability among each other. For many people, a person's word still counts.

Conversely: When I encounter people or companies who cautiously try to contractually secure themselves against all eventualities, I gladly forgo business or cooperation. Whoever occupies themselves so much with getting "beschixxen," apparently knows what they're doing. I see that as a warning sign.

Of course, the owner can do what he wants. He can also set the sale price as he wishes.

The seller can behave as shabby as he wants... he is not bound by any contract.

Romantics have had no place in this market for about 10 years now. And in real estate, only the word of the notary has counted for a very long time. That is nothing new.
